Our Contracts

1.    All our contracts with customers are on these conditions to the exclusion of all other terms and conditions.
2.    These conditions apply to all French Furniture Revolution’s sales and any variation to these conditions and any representations about the goods shall have no effect unless expressly agreed in writing and signed by a duly authorised officer of French Furniture Revolution. By making an order the customer acknowledges that it has not relied on any statement, promise or representation made or given by or on behalf of French Furniture Revolution, which is not set out in the contract. Nothing in this condition shall exclude or limit French Furniture Revolution’s liability for fraudulent misrepresentation.
3.    Each order by the customer shall be deemed to be an offer by the Customer to buy the goods subject to these conditions.
4.    The contract shall be governed by English law and the parties submit to the exclusive jurisdiction of the English courts.

Purchases / Orders

1.    After placing an order, you will receive an e-mail from our ‘Payment Service Provider’ (Secure Trading) acknowledging receipt of your order. Please note that this does not mean that your order has been accepted.
2.    Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an 'Order Confirmation' e-mail that confirms that the product is in stock, when the product will be delivered or will be ready for collection. If the product is out of stock we will inform you of the lead-time for delivery in the 'Order Confirmation' e-mail. The contract between us will only be formed when we send you the ‘Order Confirmation’.
3.    All prices on our website are in GBP and include 17.5% VAT but exclude the delivery charge, which will be added to the total amount due at the checkout. The delivery charge is calculated on the volume of goods being dispatched. For full details on our delivery charges please view our delivery section.
4.    Our furniture is hand-made and as such the order time for goods out of stock can be 2 to approximately 16 weeks (depending on level of customising). We aim to be as accurate as we can with delivery estimates but they are not binding. Delays may occur in shipping which we have no control of and we ask our customers to be patient should unforeseen delays occur. We try to show products on the Website as accurately as possible. Despite this, slight variations may occur. For example the colour of the product may vary in accordance with the settings of your computer, monitor, software or printer from the colour of the actual product you receive.
5.    All sizes of products specified on the Website are approximate only. As our products are hand-made, their actual sizes can be up to 2 cm larger or smaller than specified on the Website and we ask you to take account of this when carrying out your measurements and/or considering whether to purchase a particular product.

Refunds

1.    Customers are entitled to a full refund (but not later than 7 working days after the day after you receive the goods) BY SENDING US A WRITTEN NOTICE OF CANCELLATION (or as otherwise provided by law). In such event the customer is liable to pay for both the cost of delivery as well as the cost of returning the goods which would be the same charge as their delivery charge. The customer is responsible for ensuring the goods are properly re-packaged in the packaging they were sent in before we will collect. During this time it is the responsibility of the consumer to keep possession of the items and take care of the goods pending their return. French Furniture Revolution will only refund once the goods have been returned to French Furniture Revolution in the condition they were delivered.
2.    Refunds will not be given for any customer, specialist orders. For example, products, which have been made or altered in size, paint colour and/or wood finish other than the standard finish, stated for each, individual product on our website.
3.    Damages must be reported to French Furniture Revolution within 24 hours of delivery. French Furniture Revolution will then aim to replace the damaged item immediately. If this is not possible, (due to the replacement being out of stock) the customer will have the choice to either wait for replacement goods or will be offered a refund.
4.    When you return a product to us because you have cancelled the Contract within the statutory seven-day cooling-off period (see Refunds, point 1 above) we will process the refund due to you as soon as we have received the goods back to us in the original packaging and condition they were sent to you. We will arrange to refund you the cost of the furniture within 30 days.

Delivery

1.    Our delivery company will be in contact with the customer directly, to arrange a suitable delivery day.  The delivery company will endeavour to offer customers either an am or pm delivery slot for their convenience.
2.    Days and times for delivery are estimates only and shall not be made of the essence by notice.
3.    At the time of delivery, a person must be present to check the furniture is what was ordered and to accept the product was received in good condition (our delivery men will un-wrap the furniture for you on site).  You (or the person acting on your behalf) will be asked to sign and date a delivery note, to accept (the condition) and confirm receipt of the furniture. Delivery will only be attempted on the above terms, under no circumstance will we deliver without having the item checked and signed by the recipient (or the person acting on your behalf).  
4.    All deliveries (excluding small individual items, which will be a one man delivery) will be brought to your room of choice up to the 1st floor maximum, by two delivery men. The packaging will be removed for your convenience. It is your responsibility to dispose of the packaging on the products.  
5.    Goods will not be assembled but should you require this service the delivery company charges an additional £35 for such a service.  Please request this service as soon as you confirm your order as we need to notify the delivery company and take this additional payment prior to delivery.
6.    It is the customer's responsibility to ensure that all ordered goods fit into the home and that there is no restricted access.  French Furniture Revolution will not accept the return of items due to customers incorrectly measuring access or final resting place. The customer will need to measure doorways, staircase and all access that the goods will need to pass through. Customers will need to take into consideration space to adequately manoeuvre the goods as well.  The dimensions of the goods we deliver are approximate only. As most of the products are hand-made the customer will need to take this into consideration when measuring also. PLEASE NOTE THAT THE DELIVERY COMPANY WILL NOT ATTEMPT ANY DELIVERY THAT HAS DIFFICULT OR POTENTIALLY UNSAFE ACCESS WHICH MAY COMPROMISE THEIR SAFETY AND THAT OF OUR CUSTOMERS. Please do make sure access to the room must be cleared of all obstacles, our delivery team are not insured to move your items!!
7.    Subject to the other provisions of these conditions French Furniture Revolution shall not be liable for any direct, indirect or consequential loss (all three of which terms include, without limitation, pure economic loss, loss of profits, loss of business, depletion of goodwill and similar loss), costs, damages, charges or expenses caused directly or indirectly by any delay in the delivery, nor shall any delay entitle the customer to terminate or rescind the contract, unless such delay exceeds 180 days.
8.    If for any reason the customer fails to accept delivery of any of the goods when they are delivered or French Furniture Revolution is unable to deliver the goods on time (because the customer has not provided appropriate access, instructions, documents, licences or authorisations) risk in the goods shall pass to the customer (including for loss or damage caused by French Furniture Revolution’s negligence); the goods shall be deemed to have been delivered and French Furniture Revolution may, but need not, store the goods until delivery, and if it does provide such storage, the customer shall be liable for all related costs and expenses (including, without limitation, storage and insurance) at a cost of £20 every 2 weeks. A redelivery charge will be issued at the same cost of the initial delivery price.
9.    Delivery will be made to the address specified on your order.
10.    We will aim to fulfil your order within the delivery period set out in the ‘Order Confirmation’ unless there are circumstances beyond our control, which prevent us from doing so. We shall contact you to let you know if we are having problems getting an item to you within the specified delivery period.

Risk / Title

1.    The goods are at the risk of the customer from the time of delivery or attempted delivery.
2.    Ownership of the goods shall not pass to the customer until French Furniture Revolution has received in full all sums due to it in respect of the goods; and all other sums which are or which become due to French Furniture Revolution from the customer on any account.

Care

1.    We recommend our painted furniture be kept out of direct sunlight to avoid the paint colour fading and use of a damp cloth for cleaning. Because the furniture is painted, cracks and chips may appear in time but this is quite normal for wood furniture and should enhance the appearance.
2.    We create an aged effect on some of our goods. Any stains, cracks and chipped paint are part of the desired effect and are consequently not considered a defect.

Limitation of Liability

1.    All warranties, conditions and other terms implied by statute or common law (save for the conditions implied by section 12 of the Sale of Goods Act 1979) are, to the fullest extent permitted by law, excluded from the contract.
2.    Nothing in these conditions excludes or limits the liability of French Furniture Revolution: 1 for death or personal injury caused by French Furniture Revolution’s negligence; or under section 2(3), Consumer Protection Act 1987; or for any matter which it would be illegal for French Furniture Revolution to exclude or attempt to exclude its liability; or for fraud or fraudulent misrepresentation.
3.    Subject to the above French Furniture Revolution’s total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of the contract shall be limited to the contract price; and French Furniture Revolution shall not be liable to the customer for any pure economic loss, loss of profit, loss of business, depletion of goodwill or otherwise, in each case whether direct, indirect or consequential, or any claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with the contract.

Force Majeure

French Furniture Revolution reserves the right to defer the date of delivery or to cancel the contract (without liability to the customer) if it is prevented from or delayed in the carrying on of its business due to circumstances beyond the reasonable control of French Furniture Revolution.
